Les événements
les plus marquants en matière de piraterie maritime
Le Santa Maria navire de commerce privé battant pavillon Portugais est dérouté en pleine mer des Caraïbes dans la nuit du 22 au 23 Janvier 1961 par deux douzaines d'individus dissimulés parmi les nombreux passagers embarqués à Caracas et conduits par le capitaine Henrique Galvao réfugié politique en Argentine depuis 1959.
ACHILLE LAURO
Le 07/10/85, après avoir laissé à Alexandrie 643 passagers, l'Achille Lauro se dirige vers Port Saîd où il récupérera des excursionnistes. Il est en haute mer lorsque quatre hommes se ruent sur le pont et prennent le contrôle du poste de commandement. Les agresseurs sont des Palestiniens se réclamant du Front de Libération de la Palestine, petite fraction Pro-Arafat au sein de l'OLP et exigeant la libération de cinquante des leurs détenus en Israël.. Le navire se voit refuser l'accostage dans différents ports / Tartous (Syrie), Larnaka (Chypre)... Un passager américain, hémiplégique, de 69 ans, L.Klinghoffer a été abattu et son corps a été jeté à la mer par les pirates. Cet assassinat va provoquer un rebondissement de l'Affaire, qui présente la particularité de combiner un déroutement de navire et un détournement d'avion, entrepris aux Etats Unis, à la suite d'une interprétation très discutable de l'événement66 .
Juridique
La Convention internationale.
Indépendamment des règles propres à chaque pays, et de la jurisprudence du droit international, qui répriment les actes de piraterie, une Convention internationale sur la haute mer a été élaborée à Genève en 1958 (elle est signée par la France). Elle harmonise les règles nationales, coordonne l'action des États signataires et donne de la piraterie la définition suivante : « Est considéré comme piraterie tout acte illégitime de violence commis pour des buts personnels par l'équipage ou les passagers d'un navire ou d'un aéronef privé et dirigé soit, en haute mer, contre un autre navire ou aéronef ou contre des personnes ou des biens à leur bord, soit, dans un lieu ne relevant de la juridiction d'aucun État, contre un navire, un aéronef, des personnes ou des biens à leur bord. » L'infraction est étendue à tous ceux qui facilitent la réalisation des actes de piraterie ou utilisent en connaissance de cause le navire ou aéronef pirate.

Background : Lloyd's List ran a report of a debate about piracy at a NUMAST Conference, at which some seagoing officer speakers raised the possibility of carrying arms onboard ship so as to be able to resist pirate assaults, and cast doubts over the efficacy of measures by IMB and others to confront the menace of armed pirates.
Responses to Piracy
We saw with interest your report `Call to arms to fight piracy' (Saturday edition page 5). It does not surprise us to read that the pressing need to fight piracy with practical, as opposed to bureaucratic, means is more clearly perceived `at grassroots level' - onboard ship - than in the cloistered halls of IMO, IMB and the International Chamber of Shipping.
Whilst these last bodies call for 'international solutions' and `government initiatives' and pooh-pooh direct intervention, it is the sailors - NUMAST's members and others - who are being kidnapped, beached, set adrift in lifeboats and rubber dinghies, or summarily killed.
Clearly in today's freight market a policy of shipping a suitably-trained `ship's bodyguard' on every vessel trading in a risky area is impractical. A suggested daily cost of US$2,500 per man mentioned recently in Lloyd's List does not stand up against daily hire rates available on charter - the ship and all its 20-30 crew - often of not much more than US$5,000.-Indeed in almost any conceivable market such a solution is impossible.
We at Marine Risk Management have developed the only current practical piracy countering suite of services - ShipTrac for covert monitoring by satellite of ship movements to detect deviations, the Rapid Response Service for swift intervention on-site in case of an incident, and our soon-to-open South East Asia investigation service which, unlike others gathering ex-post-facto statistics, will be tasked with pro-active investigation of pirates and piracy incidents, ultimately to prevent them happening in the first place.
Piracy is not in its inception a "random crime". It is a commercial exercise with ships and cargoes stolen to order, recirculated and resold. It is often a conspiracy of many interests, even sometimes involving apparent "victims". Viewed in this way, it can be countered by active intelligence means. The only random element is that which confronts the hapless seafarer who confronts an armed gang of ruthless pirates boarding his ship.
Our message therefore
to our seagoing colleagues is simple. Cool it! Only tragedy will result
from inexperienced people trying to fight fire with fire. The foe is well
trained, well armed and, in most cases, highly professional. Leave intervention
and reaction to those who are best equipped and trained for it,

Adoption of ShipTrac
covert ship tracking service enables deviations by ships from expected
course to be tracked. Ships can quickly be found. The covert nature of
ShipTrac means it cannot be disabled by pirates, or crews under duress.
MRM now maintains a
growing Database of piracy incidents - historic and recent - and of the
personnel involved (actually - caught and convicted - or reputedly) in
piracy events enables "likely suspects" to be targeted for investigation
in case of an incident.
Close liaison is maintained with authorities in the areas prone to piracy incidents.
(2) Piracy hot-spots
Maritime piracy can
happen anywhere in the world. Even Europe and USA are not immune.
However, there are certain hot-spots for high seas piracy: notably South East Asia, East Africa (Somalia in particular), West Africa, and the Caribbean and the North East coast of South America.
The 'white-collar'
pirates can be anywhere and are often based in the major commercial centres
like London, New York and Singapore.

the operation before the pirates have acclimatised themselves to the ship,
or disposed of the crew, or discharged and dispersed the stolen cargo.
Action after
the event
MRM is equipped to
carry out investigations after the event for insurers and valid claimants
to locate the stolen goods, to identify guilty parties, to establish the
validity of insurance claims and recovery lawsuits, and to bring the pirates
to justice.
The further knowledge

AERIEN
Historique des détournement les plus marquants
Dans les années 1960 avec l'affaire de Cuba il y eut une recrudescence très importante de la piraterie aérienne , jusqu'à 10 détournements par jour, les années 70 à 85 virent un terrorisme très politique et d'Etat avec les grandes opérations de l'OLP, du FPLP, soutenu et dirigées par l'IRAN, la Libye et la Syrie..
De 1985 à 1990 nous avons noté une baisse sensible des actions contre des aéronefs en vol, mais cela n'est certainement pas du a une meilleure protection en amont des avions, ou à des accords en matière de protection des aéroports, mais tout simplement à un durcissement des actions des terroristes qui ont choisi une voie plus radicale qui est celle des attentats en plein vol (DC10 UTA, B 747 de la PANAM, B 747 d'AIR INDIA ) soit plus de 17 actions de ce type en moins de 5 ans . Le public et les médias n'étant informés que des actions les plus spectaculaires, et des plus meurtriers.
Les pirates sont souvent
possesseurs d'armes automatiques et d'explosifs, durant la périodes
de 1970-1974, 34 avions sont détruits au sol, et 20 en vol.
Puis de 1990 à
nos jours il y a eu une reprise des actes de piraterie, mais ceux ci sont
dès les premiers instants extrêmement violents, entraînant
toujours la mort d'innocentes victimes, dés le début du détournement.
C'est une règle quasi générale depuis lors.
1968 : Détournement vol EL AL Rome/Tel-Aviv juillet 1968 3 terroristes du FPLP embarque à bord du vol Rome / Tel-Aviv et le détourne sur Alger, avec la complicité des autorités algériennes. Les passagers non ressortissants de l'état d'Israël sont relâchés progressivement , puis quelques israéliens (familles, et enfants), pour ne garder que l'équipage et 12 passagers tous de nationalités israëliénne . Ils demandent la libération de 1200 combattants arabes prisonniers en Israël sur la base qu'un israélien vaut 100 arabes (parole d'un officiel israélien...) Après négociation avec le consul italiens à Alger et le gouvernement algérien tous les otages furent libérés contre 6 arabes prisonniers en Israël.
Dawson ' s Field
En Septembre 1970 , deux avions , un B.707 de la TWA et un Dc8 de la Swissair sont détournés vers le désert de Jordanie où ils atterrissent sur une piste abandonnée et baptisée pour la circonstance "Aéroport de la Révolution " Un autre avion devait les rejoindre , mais l'opération fut un échec. Le but étant de faire une action spectaculaire avec le maximum de publicité. Le FPLP qui avait organisé l'opération avait choisi des vols allant de l'Europe vers les USA et plus particulièrement vers New York. Le FPLP espérait avec raison que sur ces vols là, la sécurité serait moins grande que sur les vols allant vers Israël. Le choix de la fin de semaine était tout aussi étudier, car le FPLP savait qu'à cette époque là de l'année et de semaine il y aurait un maximum de passagers et de ressortissants américains à bord des avions. Les Usa sont un pays allié d'Israël ... donc le FPLP faisait coup double. Deux jours après, un troisième avion (RFA) fut détourné sur ce terrain devenu un symbole pour le FPLP.
Le FPLP savait qu'en
pratiquants des détournements , impliquant plusieurs pays, il aurait
un maximum de publicité. En effet chaque pays avait des stratégies
différentes : Israël une position traditionnelle celle du refus
de négocier, malgré un assouplissement de cette position,
l'Allemagne Fédérale et la Suisse veulent immédiatement
négocier. La Grande Bretagne a une position moyenne en acceptant
de libérer Leilha Khaled et les autres membres du FPLP emprisonnés
, après la libération des otages. La prise d'otage durant
huit jours, les otages furent libérés, les prisonniers du
FPLP détenus en Europe aussi et les avions furent détruit
sur l'aéroport de la Révolution devant toutes les grandes
chaînes de TV du monde...
.
1976 Entebbe
En Juin 1976 un Airbus A300 de la Compagnie Nationale Française est détourné sur Entebbe . Le commando du Cose-FPLP avait embarqué à Athènes au cours d'une escale. Le commando a profité d'une grève des services de sécurité de cet aéroport (!) pour embarquer avec armes et bagages à bord de l'A300. (les grenades avaient été dissimulées dans des boîtes de confiseries.... )
Après une escale forcée à Benghazi, en Libye, où sont débarqués les passagers non Israéliens l'avion se pose à Entebbe, en Ouganda. Les négociations ayant échoué, dans la nuit du 3 au 4 juillet, le Gouvernement israélien décide l'envoi de deux avions remplis de parachutistes et de quatre avions d'appui. A l'arrivée à Entebbe les troupes donnent l'assaut et en moins de 90 minutes, détruisent 11 avions militaires Ougandais, tuent les terroristes et libèrent les otages. Il y eu une victime parmi les otages, une personnes âgées qui avait été transportée à l'hôpital et qui selon la rumeur, fut étranglée par Immin Dada lui même. Parmi les troupes libératrice fut un lieutenant-colonel le frère de Benjamin Netanya hou, ancien premier Ministre .
1985 Détournement du vol TWA Athènes/Rome
En Juin 1985 un commando du Hezbollah détourne le vol 847 de la TWA entre Athènes et Rome. Il tue un des passagers et en libère une centaine à Alger, puis à Beyrouth, une quarantaine de passagers américains sont gardés et dispersés dans divers lieux de détention, dans la banlieue sud de Beyrouth (Bir-El-Abed) . Le chef des chiites Amal, Nabih Berri , exige la libération des chiites détenus par Israël, l'éloignement des côtes libanaises de la flotte de guerre américaine. Les Etats Unis se servent des bons offices de Berri et obtiennent la libération par Israèl de militants chiites détenus dans ses prisons. Reagan considère que toutes les conditions ne sont pas remplies pour envisager une libération des passagers par la force. La négociation est privilégiée dans ce cas précis et loin d'être un échec pour les USA. Elle devient un modèle de résolution non violente des détournements aériens. L'avion se rendra ensuite à Alger. Douze terroristes ont pu embarquer à Beyrouth, rejoignant les deux premiers , ce qui portait à 14 le nombre de terroristes à bord, tous armés de fusils automatique M-16 et de lance grenades ce qui rend toute intervention impossible. Ce fut le détournement le plus long de l'histoire de l'aviation : 3 semaines.
1985 Détournement du vol Egypt'air Athènes/Le Caire
En Novembre 1985 le détournement du vol Athènes/ Le Caire tourne au drame le plus complet. Il y a eu 59 morts et 29 blessés en raison de l'intervention du groupe spécial égyptien. Le manque de préparation des troupes et le manque de négociation furent nettement insuffisantes. Ce détournement est l'_uvre du groupe d'Abou Nidal dans le but de déstabiliser l'Egypte. Ce détournement montre les limites des positions intransigeantes des autorités face à des terroristes déterminés, il révèle ensuite les limites de certaines forces d'intervention , celles en particuliers des pays en voie de développement . ce fut aussi le premier détournement ou un otage femme fut abattu.

Le détournement
a été exécuté par des musulmans SALAFISTES,
groupe LASKHAR-I-TAYYABA stationné au CACHEMIRE soutenu par la PAKISTAN
et BEN LADEN .
Qui sont-ils?
Lasskhar-I- Tayyaba (LT Armée des purs) , il combat au Cachemire depuis 1989 et apparaît comme une branche armée du Dawat-wal-Irshad , il est dirigé par Zakiur Rehman Lakhvi.
Les combattants du LT sont tous Pakistanais, souvent des adolescents originaires de villages et de petites villes de la PNO ou du Penjab. Contrairement à ses rivaux, le LT ne réclame pas le rattachement du Jammu-Cachemir au Pakistan, mais l'indépendance. Pour Zakiur Rehman Lakhvi, les revendications territoriales du Pakistan sont illégitimes, tout comme les négociations indo-pakistanaises sur le sujet, le sort du Jammu-Cachemire doit se régler entre les Moujahedin et l'armée indienne, par les armes.
En Février 1999 alors que les rumeurs courent sur la disparition d'Oussama Ben Laden, le Laskhar-I-Tayyaba presse le milliardaire saoudien d'aider les musulmans dans leur lutte contre l'armée indienne.
Ce groupe est aussi actif en Bosnie, en Tchétchénie, au Soudan, aux Philippines....
Distinction entre les islamistes et les fondamentalistes ou salafistes.
Les mouvements islamistes
comme la confrérie des Frères Musulmans, le Refah (fondé
par Naçmettin Erbakan en Turquie sous le nom de Milli Nizam -parti
de l'ordre-, le Refah -parti de prospérité- a été
dissous le 22/02/98 et a pris le nom de FAZILET -parti de la vertu-) ou
le JIP développent une doctrine politique de l'islam qui prend en
considération la société moderne avec toute sa complicité
: une véritable société islamique ne saurait pas se
limiter à l'application de la Charia.
Ainsi :
ils ne recrutent pas
leurs cadres parmi les Oulémas mais au sein d'une élite généralement
formée à l'occidentale.
Leur modèle
organisationnel est nettement influencé par le Marxisme
Ils défendent
une position originale de la femme dans la société islamique
, si ils refusent la mixité et ordonnent le port du voile :"alors
que l'enfermement traditionnel ne se voit pas, le voile militant est un
défi-" , ils acceptent en grande partie l'ascension sociale des
femmes, celles-ci peuvent faire des études supérieures et
travailler.
Ils ne sont pas à
priori hostiles aux chiites.
Au contraire les Salafistes
sont tous des puritains et des fanatiques dénués de tout
projet politique et uniquement soucieux de la restauration de l'ordre moral
par l'application rigoureuse de la Charia. Ces ultra-fondamentalistes veulent
restaurer la pureté originelle de la religion et prônent le
retour de l'Islam du Prophète et de ses successeurs immédiats.
Ce commun désir de retours aux Salafs, les grands ancêtres
conduit à désigner du terme Salafiya la tendance générale
qu'ils représentent. Aujourd'hui la Salafiya la tendance générale
qu'ils représentent. Aujourd'hui la Salaiya la plus militante se
confond avec la Wahhabia (doctrine Wahhabite).
Les principes de la Salafiya :
La prédication salafiste repose sur trois piliers :
monothéisme
absolu, unicité parfaite de Dieu (Tawhid)
purification constante
de l'âme par l'adhésion stricte à la loi divine : impératif
d'intégrité et de droiture, horreur de la corruption et de
l'hypocrisie.
Reconnaissance du
Coran et de la Sunna comme les deux sources indiscutables de l'Islam.
Par ailleurs les Salafistes
:
refusent l'intercession
et toute forme de mysticisme
tiennent les chiites
pour hérétiques
déclarent apostats
(s'ils apostasient , appréhendez les et tuez les ou vous les trouverez)
- par conséquent assimilés aux infidèles - et non
seulement pêcheurs, les musulmans qui ne se conduisent pas selon
les purs canons de l'islam.
Le courant salafiste s'étend de l'Algérie (GIA ) à l'Afghanistan (les Talibans), au Pakistan il est principalement représenté par le JUI et le SSP.
Quant au détournement
en lui même il est la copie du dernier grand détournement
que nous avons connu en France avec la prise d'otages sur le vol AF Alger/Paris.
Il est a remarquer
que le scénario est identique quant à la maniére de
terroriser les otages et le fait d'une violence toujours grandissante au
fur et à mesure que le temps passe. La première action a
été de tuer immédiatement un otage.
Les armes lors des premiers instants du détournements étaient du type classiques , mais lors d'une escale elles furent changées et les terroristes furent réapprovisionnés par leurs "frères Talibans".
Il a fallu des complicités
extérieures lors de ce détournement; complicités dans
les aéroports et au niveau des négociateurs ou des pays "influents".
Dans ce coup là
l'Inde a mangé son "turban" puisque ce pays a du libérer
plusieurs terroristes Un de ces terroristes , Mushtaq Ahmed Zargar un Cachemire,
est retourné au Pakistan, un autre AH MAD Omar Saeed Sheikh qui
a un passeport Britannique et reparti pour le Pakistan mais personne ne
l'a revu en public. , quant aux 5 pirates de l'air on ne sait pas où
ils sont.
Pour avoir une chronologie
complète et sérieuse sur le détournement lui même,
il serait important de "débriefer" les trois otages français,
ceci ne peut se faire qu'avec un groupe de travail officiel soit au titre
de la recherche, comme au sein d'une université, ou avec ceux qui
doivent gérer ce genre de crise.
Il serait très
intéressant de connaître la vie des otages au cours du périple
de l'avion, l'attitude des otages au fur et à mesure que les jours
passaient, y a-t-il eu pour certains le syndrome de Stockholm, quel fut
l'attitude de l'équipage PNT et PNC, pourquoi sont-ils resté
cagoulés durant tout le détournement, pourquoi ont-ils tués
un de leur complice, était-il un dur ou son contraire,
Les réponses à ces question seraient à comparer avec le timing de la négociation pour cerner à quel moment la situation se dégradait et pourquoi, connaître aussi le degré de stress des preneurs d'otages et des otages .

NEW DELHI: Eight days
of crisis management can take a lot out of you. But while the nation worried
over the welfare of the hostages aboard the hijacked IC814, few cared how
the crisis managers at Rajiv Gandhi Bhawan here were doing.
Now, it turns out,
they managed quite all right.
Meals for over 50 people, three times a day, kept them going. And between bouts of crisis management came cutlets, sandwiches and endless cups of tea. Tired bureaucrats once sent for a pack of playing cards to relieve the tension.
The crisis over, the Airports Authority of India will now pick up the bill. Itprobably does not have a choice. "The argument is that the crisis management centre was in our premises,'' laments an AAI official who does not want to be identified. ``All the bills are coming to us.''
Although there is no final figure yet on how much it all cost, AAI has decided that it will pay only where its parent ministry, civil aviation, is involved.
AAI chairman D V Gupta,
when contacted, said no such bills had come to him. ``The bills go to concerned
departments within the authority. I will have to find out.''
Other senior AAI officials,
however, said they were taken aback a few days ago to learn there was a
bill from the external affairs ministry for Rs 20,000 -- for tea and ``miscellaneous
expenses''. The tea, the MEA said, was served to agitated relatives of
those held hostage on the hijacked plane.
The AAI, privately sore over the cost of crisis management, has for now decided not to buy this one. Last heard, the bill was on its way back to the MEA. ``We are relieved Indian Airlines has not sent us its bills,'' quipped an AAI official.
But the crisis has
shown that the civil aviation ministry likes to treat guests in style.
Personnel from the ministry were on their toes for most of that period.
``The food served
had to be proper, neatly packed from Ashok Hotel and complete with chicken
and roti,'' a source disclosed. ``The show had to go on for the 8-day period.''
Cutlets ordered at one time cost Rs 400. A member of the CMG, however,
noted during the crisis that the quality of bread served was poor.
The hijack crisis
may have been a nightmare for the hostages, their relatives and even the
government. But for AAI, there is another story, concealed in the expense
account under the head: `miscellaneous'.
India maintains that the hijackers have sought refuge in Pakistan India has asked Pakistan to extradite the five hijackers of an Indian Airlines plane so that they can stand trial there. This is the first official diplomatic demand by Delhi since the hijacking in December. The Pakistani High Commissioner to India, Ashraf Jehangir, was summoned to the Ministry of External Affairs in Delhi and told that his country had a legal obligation to extradite the hijackers and their accomplices to India. Islamabad has always denied that the hijackers are in Pakistan, and has demanded that Delhi provide hard evidence for this assertion.
The authorities in
Pakistan have said that they will arrest and try the hijackers if they
enter the country. Islamabad has also denied India's allegation that it
masterminded the hijack.
Hijacking: US sees
'evidence'

WASHINGTON, Jan 12: The Indians have provided "some evidence" to US officials on alleged Pakistan involvement in the Indian Airlines hijacking, a senior State Department official said on Tuesday.
"We have spoken to Indian officials about the evidence they have. In fact, we have seen some of it. I can't say categorically that we have seen it all. That is something that we are working with them on," the official told Dawn. But observers said India was still far from convincing the US to declare Pakistan a state sponsor of terrorism based on the evidence in the hijacking case.
The real opposition to the Indian moves is coming from Congress and even pro-Indian congressmen do not believe that declaring Pakistan a terrorist state would help US policy and strategic interests.
Congressman Sam Gejdenson said in New Delhi on Tuesday "declaring a country a terrorist state was a tough call and led to loss of leverage. Putting a country out is also a statement of failure. In Sudan, in Libya, it has taken decades to get any kind of progress," he said.
The chairman of the influential Government Reform Committee, Congressman Dan Burton, issued a statement in Washington criticizing India for issuing inflammatory statements regarding the hijacking.
"I would hope that the Indian government would stop making public statements regarding the hijacking. Every statement I have seen from the Pakistani government has condemned the hijacking and I am told that they are committed to seeking the arrest and prosecution of the hijackers," Burton, a close friend of Pakistan, said.
He implicitly accused India of "trying to exploit the situation for domestic political purposes" and said "this is a time for all governments, including the US, to work together to bring these people to justice."
The State Department official was asked to elaborate the statement of the US ambassador to India, Richard Celeste, that the US would be working closely with the Indians to track down the hijackers of the plane who disappeared in Afghanistan after India freed three of their leaders.
The US has pledged to combat terrorism anywhere and we will work with various countries to track down these hijackers and the Indians have a lot of information about them and there was after all an American citizen on board, he said.
Asked whether the US officials found anything implicating Pakistan in the evidence that they had seen, the official said: "I am sorry we cannot comment on the specific evidence as the investigation is going on and we don't share information about that."
The US ambassador in
New Delhi had earlier said the US will not rest until the hijackers were
tracked down and brought to justice. His government would work closely
with the Indian home (interior) ministry in tracking down the hijackers.
"We take terrorism extremely seriously, we do not want anyone to feel there
is a safe harbor," he said.

to stand trial here, the foreign ministry said in New Delhi.
The official demand
is the first by India since December 31 when the hijackers released 155
passengers in the Afghan city of Kandahar and crossed its borders into
Pakistan.

- India called on Pakistan on Saturday to hand over five hijackers of an
Indian plane who it said were believed to be in Pakistan.
The Pakistan High
Commissioner to India, Ashraf Jehangir Qazi was summoned to the foreign
office and told that Pakistan had legal obligations to arrest the hijackers
and their accomplices and extradite them to India.
``Given that a large
number of terrorists whose release was sought by the hijackers are Pakistani
nationals and the first destination chosen by the hijackers was Lahore,
there were strong grounds for believing that the hijackers were currently
in Pakistan,'' India's Foreign office spokesman said.
``The Pakistani High
Commissioner was also informed that the Government of India reserved the
right to take further measures as appropriate,'' the spokesman said without
elaborating.
Pakistan says it has
no knowledge about the identity of the hijackers, whose eight-day operation
ended in Afghanistan on December 31 when India agreed to free three militants
from jails in Kashmir in exchange for the 155 hostages aboard the plane.
Pakistan has vowed
to arrest and try the hijackers if they enter the country and denies Indian
allegations that it had masterminded the hijacking of the plane while on
a flight from Nepal's capital Kathmandu to New Delhi.
The plane landed at Kandahar in southern Afghanistan after stops in India, Pakistan and the Middle East. The hijackers freed the hostages after eight days in exchange for three guerrillas who were released by India.
India and Pakistan
have fought three wars since 1947. Last year the two teetered on the brink
of a fourth when India fought a large guerrilla force close to its border
with Pakistani-held Kashmir.

- India asked Pakistan on Saturday to arrest and extradite the five Indian
Airlines hijackers who disappeared in Afghanistan after a militants-for-hostages
swap, officials said.
Pakistan ``had the
clear obligation to take (the hijackers) into custody and extradite them
to India,'' Foreign Ministry spokesman Raminder Singh Jassal said in a
statement.
India has said for two weeks that the hijackers fled to Pakistan after they left the Indian Airlines plane in the Afghan city of Kandahar. Pakistan denies that the hijackers are in its territory.
On Dec. 31, the hijackers fled the plane after India released three Islamic separatists in exchange for the remaining 155 hostages. The hijackers, who killed one passenger during an eight-day standoff, had earlier demanded the release of 36 militants lodged in Indian jails.
India's statement Saturday
said a large number of the terrorists who the hijackers wanted released
were Pakistani nationals and that the Pakistani city of Lahore was the
hijackers' first destination when they forced the plane to fly out of India.
These were indications that the hijackers were currently in Pakistan, the
statement
said.
India has identified
the hijackers as Pakistanis and released pictures it claims are of the
five men. Indian police had also arrested the hijackers' alleged accomplices
in the western city of Bombay.
India has not signed a bilateral extradition treaty with Islamabad. But Jassal said Pakistan's government is bound under international aviation conventions to apprehend the hijackers and their accomplices in Pakistan.
Pakistan, though, has said all along that it doesn't where the hijackers are.
"They did not come
to Pakistan,'' Pakistani Foreign Ministry spokesman Tariq Altaf said last
week.
Pakistan is India's
western neighbor and bitter rival of 52 years. New Delhi accuses Islamabad
of arming and funding a decade-old insurgency in the northern Jammu-Kashmir
province, a charge denied by Pakistan. The rivals have fought two of their
three wars over the Kashmir's Himalayan landscape.
